The Treaty of new echota
The Treaty of New Echota was basically the legal base for the removal of the Indians. It was ratified after it was signed by U.S. officials and the representatives to a small Cherokee political unit, despite the protests of the majority of the Native American population and the fact that it wasn't signed by the main Cherokee chief, John Ross. The terms were that all land of the Indian people were seceded to the American government. Even though it was passed by unofficial means, it still stood strong enough to carry out the act of removal.
